Thank you for choosing The Sticker Society for your design and print needs.

These terms and conditions explain how we work with you, including processes around orders, payment, delivery, and important legal matters relating to intellectual property. 1. Parties

1.1 These terms and conditions form a binding agreement between The Sticker Society (ABN 67956622903) (“The Sticker Society”, “we”, “us”) and the person or entity placing an order (“you”, “the client”).

2. Orders

2.1 Orders can be placed via our website or by emailing info@thestickersociety.au.

2.2 Discussions and quote requests are welcome prior to order placement. No agreement is formed until we accept your order and receive cleared payment.

2.3 If errors or incomplete information occur during ordering, we may contact you to clarify.

2.4 Custom orders will have deliverables specified in an order summary or final proof. Additional variations beyond the order summary will incur extra charges.

3. Our Services

3.1 We provide both custom and ready-made design and print services.

4. Payment

4.1 Prices are listed on our website or specified in your quote.

4.2 Payment must be made through accepted methods at checkout or as detailed in our confirmation.

4.3 Work commences only after full, cleared payment.

4.4 Payment failures make you liable for associated fees. Third-party payment facilities (e.g., PayPal) are used at your risk.

4.5 Prices may be varied before order acceptance.

5. Design and Print

5.1 Customer Supplied Files

  • Files must be print-ready, at least 300 DPI, and in PNG, AI, EPS, JPEG, or PDF format.

  • Fonts must be outlined or font names supplied.

  • Redesign or file preparation incurs additional fees.

5.2 Custom Design

  • Information must be supplied within 14 business days.

  • No refunds are offered for change of mind once the design process starts.

  • If paused, monthly communication is required. After 6 months of no contact, the project is forfeited, with a 20% restart fee for resumption.

6. Cancellation of Orders

6.1 Orders cancelled before work commencement are eligible for a refund minus:

  • 15% administration fee, or

  • 20% fee if from a prior financial year.

6.2 Orders may be cancelled within 6 months of purchase with monthly updates.

7. Proof & Acceptance

7.1 Final layouts are provided for your approval. You must check all elements (design, text, sizing, material, quantity).

7.2 Approval is final. Errors post-approval are your responsibility, and changes post-proof may attract additional charges.

8. Colour Variations

8.1 Printing is done using CMYK printers. Colour variations between screens and printed products may occur. We disclaim liability for colour differences.

9. Deliverables

9.1 Deliverables are specified on the product page or in your quote.

9.2 For custom work:

  • “Without files” option: Printed products only; no design files provided.

  • “With files” option: PDF design files provided. Working files (e.g., Canva, CorelDraw) available at additional cost only.

10. Intellectual Property

10.1 We retain all intellectual property (IP) rights in designs and materials created by us.

10.2 You grant us a license to use any materials you supply for fulfilling your order, warranting you own or have rights to these materials.

10.3 Your materials must be lawful, non-infringing, and appropriate.

11. Ready-Made and Custom Designs

11.1 Ready-Made Labels

You receive printed labels only, under our License. No design files or ownership of IP is transferred.

11.2 Custom Labels

  • Printed Labels Only: You receive printed labels under our license without IP rights.

  • Printed Labels + Files: You receive a PDF or EPS file of the design and font links. IP rights remain with us unless stated otherwise.

11.3 Logo Designs

Upon full payment for logo designs:

  • You acquire ownership of the IP rights.

  • We retain IP ownership until full payment is made.

12. Our License

12.1 We grant you a royalty-free, perpetual, worldwide, non-exclusive license to use our materials for your personal or business use, subject to restrictions:

  • No sublicensing, resale, sharing, distribution, or unauthorised modification is allowed.

  • No use that infringes law, third-party rights, or is offensive or misleading is permitted.

12.2 Breaching our license results in immediate revocation, and we may seek damages or other remedies.

12.3 We may use our materials in promoting our business or in competitions.

13. Postage and Delivery

13.1 Shipping and Delivery

  • Shipping costs apply to Australian addresses. Contact us for international shipping quotes.

  • Estimated dispatch timeframes are listed but subject to change due to external factors.

13.2 Delivery Address Responsibility

Ensure your delivery address is correct. Errors causing failed delivery are your responsibility.

13.3 Domestic Postage

Orders are shipped via Australia Post or an equivalent service. Tracking reference numbers are provided.

13.4 Risk

Risk passes to you upon delivery. If left unattended as per your authority, the order is deemed delivered.

14. Refunds and Returns

14.1 Refunds are offered in accordance with Australian Consumer Law only.

14.2 No refunds are provided for change of mind or after commencement of work.

14.3 Contact us within 14 days for refund or issue resolution at info@thestickersociety.au.

15. Limitation of Liability

15.1 Our liability is limited, at our discretion, to:

  • Refund;

  • Replacement;

  • Repair; or

  • Re-supply of services.

15.2 We are not liable for errors approved at proofing or for consequential or indirect losses.

15.3 If ACL does not apply (e.g., international orders), liability is excluded.

16. Termination

16.1 We may terminate the agreement with notice. Upon termination:

  • You must pay for all work completed.

  • We refund payments for goods/services not provided.

16.2 Certain clauses survive termination.

17. General

17.1 Advice and Information

General advice is provided in good faith but is not a substitute for professional advice.

17.2 Dispute Resolution

  • Attempt amicable resolution first.

  • Failing that, mediation will occur in Brisbane, Queensland, with shared costs.

17.3 Events Beyond Control

We are not liable for delays due to unforeseen events (e.g., natural disasters, lost deliveries, system failures).

17.4 Privacy

Privacy is governed by our Privacy Policy available on our website.

17.5 Variation

We may vary these terms by posting updates on our website.

17.6 Severance

If any term is invalid, the remainder remains effective.

17.7 Jurisdiction

These terms are governed by Queensland law, and disputes are subject to the exclusive jurisdiction of Queensland courts.
